Obama Attorney General Orders Terrorist Trial in
New York City

Attorney General Eric Holder says he decided to bring the suspects to trial
in New York because of the nature of the undisclosed evidence against them,
because the 9/11 victims were mostly civilians, and because the attacks took
place on U.S. soil.
Khalid Sheikh Mohammed ('KSM'), the reputed al Qaeda plotter of the 9/11
terrorist attacks, will be put on trial in federal court in Manhattan, near
the site of the World Trade Center Sept. 11th attacks. He is likely to also
face outstanding charges in a secret 1996 indictment for his alleged role in
the 1994 'Bojinka' plot - described by the 9/11 Commission as "the intended
bombing of 12 U.S. commercial jumbo jets over the Pacific during a two-day
span."
Four other Guantanamo Bay detainees -- Walid Muhammed Salih Mubarak Bin
Attash, Ramzi Bin Al Shibh, Ali Abdul-Aziz Ali, and Mustafa Ahmed Al Hawsawi
- will also be tried in the U.S. District Court for the Southern District of
New York.
Prosecutors are likely to face defense challenges over KSM's water
boarding while he is was in U.S. Custody.
Defense attorneys for KSM, and for other accused 9/11 terror detainees, are
sure to put up a legal fight over any detainee confessions allegedly
obtained using extreme measures, torture, or interrogations and seek
depositions and discovery of sensitive military operations in Bush's War on
Terrorism.
The former mayor of New
York City, Rudy Giuliani, says putting suspected Sept. 11 terrorists on
trial in New York City places residents there at unnecessary risk.
Giuliani tells CNN's "State of the Union" that a more appropriate choice
would be military tribunals for the terror suspects. He says that option
recognizes that the U.S. is at war with Islamic terrorists. Giuliani was
mayor of New York when terrorists attacked the World Trade Center on Sept.
11, 2001.

Pay attention to Eric Holder’s law firm and Gitmo detainees By Michelle

Eric Holder is a senior partner with Covington & Burling, a prestigious
Washington, D.C. law firm, which represents 18 terrorists held at Guantánamo
Bay.
They continue to pursue relief in the D.C. Circuit under the Detainee
Treatment Act of 2005 for all of their clients. On a separate front, they
filed amicus briefs and coordinated the amicus effort in Hamdan v. Rumsfeld
in which the Supreme Court in the summer of 2006 invalidated President
Bush’s military commissions and in which they have obtained favorable
rulings that their clients have rights under the Fifth Amendment and the
Geneva Conventions.
The fact that Mr. Holder, while Deputy Attorney General, pushed for the
release of 16 violent FALN terrorists against the advice of the FBI, the US
Attorneys who prosecuted them and the NYPD officers who were maimed by them,
suggests that he was perfectly willing to put politics before the national
security interests of the country. He is not suited for the job of attorney
general, which is central to the issues surrounding the disposition of war
on terror detainees.
