Michael Newdow: "As I'm standing in line, I'm looking at the twenty dollar bill, and
it says 'In God We Trust.' What the heck is this doing here? It just had never hit me. I
looked at the ten dollar bill. 'In God We Trust.' And the five and the one and all the
change. I thought, 'What is going on here? I don't trust in God. I'm an
American." "As I thought about it, I realized that the case to get 'under God'
out of the pledge was stronger."
Michael Newdow, a physician and atheist, sued the Sacramento County, California, school
district his daughter attended, claiming public recitation by students violates the
10-year-old child's religious liberty. While legal precedent makes reciting the pledge a
voluntary act, Newdow says it becomes unconstitutional for students to be forced to hear
it.
Newdow, who is not a practicing attorney, made an argument, declaring his daughter would
be singled out by not saying the Pledge, and would be coerced to participate.
"Imagine you're a third-grader in a class of 30 kids. That's enormous pressure to put
on a child" to conform, Newdow said.
Complicating matters is Newdow's legal standing because of a custody dispute between him
and the girl's mother. The two never married. Sandra Banning believes the pledge is a
"patriotic expression" and claims her daughter does not object to reciting it.
The court spent significant time debating that issue, but offered no clear indication
where it would rule on that aspect of the case.

Michael Newdow is the Sacramento, California emergency room doctor who argued Elk Grove
Unified School District v. Newdow before the US Supreme Court in March 2004. The case was
aimed at excising the words "under God" from the Pledge of Allegiance, which
Newdow believes violates the legal doctrine of separation of church and state. In his
suit, the doctor essentially claimed that his 10-year-old daughter was being brainwashed
every time she was prompted to recite the Pledge in her elementary school classroom.
The US Supreme Court dismissed Newdow's case on 14 June 2004 -- exactly 50 years to the
day after President Eisenhower signed the law adding the words "under God". The
Supreme Court held that since Newdow happened to be in the middle of a bitter custody
battle, he doesn't have legal standing to sue on behalf of his daughter. The girl's
mother, Sandra Banning, happens to be a devout Christian, so no help there.
Newdow claims he was the victim of date rape, perpetrated by Banning during a
camping trip at Yosemite National Park. "I specifically said 'no' multiple times
before and during sex. Was I forced into being a father? He also sometimes refers
to himself (even in some court documents) as "The Rev. Dr. Michael Newdow, Esq."
